Second Order of the Commissioner General for Public Safety on the Conduct of Jews in Public On the basis of article 45 of Ordinance 138/1941 of the Reich Commissioner for the occupied Dutch territory regarding the maintenance of public order, it is determined: Article 1. Jews must stay inside their homes between 20:00 to 06:00. Article 2. Jews are prohibited from being in houses, gardens, or other private places of recreation of non-Jews in as far this may not be necessary on the basis of existing rental or labour agreements. Jews who are married to non-Jews are exempt form this order. Article 3 (1). Jews may only enter shops between 15:00 and 17:00, which have not been designated as being Jewish. Pharmacies are exempt. (2). Jews are prohibited from having goods delivered at their homes. (3). This ordinance falls outside the specific measures that have already been ordained for the City of Amsterdam by the Plenipotentiary of the Reich Commissioner or which may be ordained. Article 4. Jews are prohibited to enter hairdressers or any other paramedical institutions or to use their services in as far as these institutions are not designated as Jewish. Reference is made to paragraph 2 of the instruction of the Reich Commissioner for the occupied Dutch territory in execution of Ordinance 198/1941 of 30 June 1942 regarding the arrangements for the execution of a profession by Jews. Article 5 (1). Jews are prohibited from entering railway premises and to use public and private transport. (2) Exempt are (1) the use of ferries, (2) using bicycles within the municipal area of Amsterdam, (3) using tricycles for transporting goods for commercial purposes as permitted for the specific occupation, (4) transporting seriously ill persons in an ambulance and transporting invalids in special vehicles, (5) using means of urban transport by the owner of a driver’s licence recommended by the Weapons Inspector of the Netherlands and granted by the Security Police, (6) using the railways with a travel permission granted by the Security Police, (7) using means of transport by persons in possession of a travel permission issued by the Central Office for Jewish Emigration, Amsterdam. (3) Jews who may use public transport in the above circumstances must travel in the lowest class (smokers’ section). They may only alight and take their seats when there is sufficient place for non-Jewish travellers. Article 6. Jews are prohibited to use a public telephone. Article 7. In the ambit of this Ordinance a Jew is one who in terms of article 4 of Ordinance 189-1940 on the reporting of companies is a Jew or is regarded as a Jew. Article 8. Plans for putting into operation and further exemptions from paragraphs 1 – 6 will be announced in the Jewish weekly. Article 9. He who contravenes the provisions of paragraphs 1 – 6, or who circumvents these, will receive – in as far as a heavier penalty is foreseen in another ordinance – a penalty of being placed under arrest for a maximum of six months or a fine of a maximum of one thousand guilders or with one of these penalties. Everyone is also subject to these provisions who sees to it that they are circumvented or who collaborates in the process. The right of the Security Police to take the necessary measures is not encumbered. Article 10. This order is valid as from the day it is announced. ‘s-Gravenhage, 30 June 1943. The Commissioner General for Public Safety RAUTER SS Gruppenführer and Lieutenant General of the Police Instruction from the Reich Commissioner for the occupied Dutch territory for the execution of Ordinance 198/1941 relating to the arrangements for following a profession by Jews. On the basis of article 2 of the Ordinance No. 198/1941 relating to the arrangements for following a profession by Jews, I hereby determine: Article 1. Jews are prohibited from working as an auctioneer, pawnbroker, labour or professional broker, counsellor for professional guidance, economic, financial and tax matters, pharmacist, marriage broker or guide for foreigners. Areticle 2 (1). Jews are prohibited to work as an accountant, also in terms of special education or paramedical professions, unless this is done exclusively on behalf of another Jew. (2). Under a paramedical profession, mentioned in the previous sentence, is meant the profession of a lecturer in health gymnastics, natural healer, oculist, chiropodist (pedicure and manicure), bandagist, masseur, beautician and hairdresser. Article 3 (1). Jews are prohibited from working as a street vendor, with the exception of trading in goods of old metal, lumps and scrap. (2) In the area of Amsterdam or in specific areas of the abovementioned the Plenipotentiary of the reich Commissioner of the City of Amsterdam may request that exemption may be granted from the prohibitions contained in the previous sub-article. Duties will be payable for such exemption. Article 4. An activity mentioned in sub-articles 1 and 2, as well as an activity for which no exemption exists in sub-article 3 or is to be solicited, may be executed until 31 July 1942, in as far as it takes place in executing an existing agreement upon this Ordinance taking effect. Article 5 (1). In the ambit of this Ordinance a Jew is one who in terms of article 4 of Ordinance 189-1940 on the reporting of companies is a Jew or is regarded as a Jew. (2) Actions in contravention with the stipulations of this instruction will be punished in terms of article 6 of Ordinance 138/1941 regarding the maintenance of public order, as amended by Ordinance 182/1941 on predetermined punishments. The Reich Commissioner for the occupied Dutch territory On his behalf: DR HANS FISHBöCK Commissioner General for Financial and Economic Affairs Non-Jews not to enter In order to avoid any misunderstanding apropos various questions the appropriate German authorities have pointed out very clearly that paragraph 2 of the second order for Jews, issued by the Commissioner General for Public Safety should be interpreted that Jews are strictly prohibited from entering the homes of non-Jews. The exceptions are described in the relevant order for specific cases. Jews must hand in their bicycles Order by the Commissioner General for Public Safety regarding bicycles in Jewish possession. On the basis of article 45 of Ordinance 138-1941 regarding the maintenance of public order, as amended by Ordinance 182-1941, I am ordering: Article 1(1). Bicycles that are the legal or economic possession of Jews have to be handed in no later than 24 June 1942 at 13:00, together with their spare parts, including reserve inner tubes and tyres, in a rideable and proper condition, to the mayor of the municipality where the Jew lives or has his business. (2). Bicycles also have to be handed in when they have a right to use them. (3). The handing in is to be done by: 1. The owner; 2. Whoever is entitled to represent the owner; 3. Whoever holds a bicycle in the occupied Dutch territory or has one under his care. Article 2. It is prohibited to lend a bicycle for a longer or a shorter period to a Jew. Article 3. This order is not applicable to bicycles, whose 1. Spare parts belong to Jews living in the City Of Amsterdam, or 2. Belonging to the supply of a bicycle trader. Article 4. In the ambit of this order a Jew is one who in terms of article 4 of Ordinance 189-1940 on the reporting of companies is a Jew or is regarded as a Jew. Article 5 (1). On whomever the obligation rests in terms of article 1 and not hand in the bicycle timeously or completely, acts in contravention with the prohibition in article 2 and will be punished by being in arrest for a maximum of six months and with a fine of a maximum of one thousand guilders or with one of these penalties.
